Does ChatGPT really delete your data? No — here’s what happens
When you press “Delete” on ChatGPT, Claude or Gemini, your conversations don’t really disappear. What retention rules, a 2025 court order and training terms actually mean for your privacy — and the one setup where deletion is guaranteed.
Short answer: “Delete” is not what it sounds like
On the big public AIs — ChatGPT, Claude, Gemini, Grok — pressing “Delete” does not reliably make your conversation vanish. Sometimes it starts a 30-day countdown; sometimes a legal obligation freezes it in place; sometimes it was already used to train the model. What “Delete” does on ChatGPT
According to OpenAI’s own policy, when you delete a chat it is scheduled for permanent removal within 30 days — unless it must be kept for legal or security reasons, in which case it can be retained indefinitely. In other words: the delete button works only until an obligation says it doesn’t.

The New York Times case (2025)
This is not theory. Between May and September 2025, a court in the copyright lawsuit brought by The New York Times ordered OpenAI to preserve every ChatGPT conversation — including chats users had deleted and even “temporary” ones — on the Free, Plus, Pro and Team plans. Around 20 million conversations were ultimately handed over to the newspaper’s side for review.
To be fair: that broad preservation order was narrowed in October 2025 for conversations going forward, so this describes a specific window rather than a permanent state. But it proves the point that matters: once your data sits on someone else’s servers, a third party can force it to be kept and disclosed — no matter what the delete button led you to believe.

Claude and Gemini: kept for years, right now
The other big assistants keep your conversations by default, today:
- Claude (Anthropic): since August 2025, consumer chats can be used to train the models and are retained for up to 5 years — unless you actively opt out.
- Gemini (Google): conversations selected for human review are kept for up to 3 years, and deleting your activity does not remove those reviewed copies.

What this means for you, in plain terms
If you paste a contract, a medical record, a client’s details or your source code into a public AI, you should assume it may be stored — for weeks, for years, or until a court says otherwise. “Delete” gives you a feeling of control, not a guarantee.
